Citizen’s benefit: sanctions without effect

If beneficiaries of citizen’s benefit do not cooperate at all or not enough in their job placement, job centres often cannot respond effectively. Our audit shows that the statutory options in place are not enough. The principle of “demanding” should be strengthened.

We found that some of the beneficiaries of citizen’s benefit had not cooperated enough in their job placement – in some cases for many years. Some have never showed up for job counselling appointments or could also not be reached by phone. The current option of reducing citizen’s benefit by up to 30 per cent of the standard needs rate often had no apparent effect.

Cooperation is no prerequisite

In contrast to unemployment benefit, receiving citizen’s benefit is, in principle, not linked to actual cooperation in the job placement. The result: Even if beneficiaries categorically refused to cooperate, they did not face any real consequences. This jeopardises public acceptance of the citizen’s benefit system.

Tighten measures

The job centres need to be provided with feasible and legally certain instruments to be able to respond to persistent refusal to cooperate in a timely and noticeable manner. The legislator should create an independent statutory framework which clearly specifies the conditions and scope of tightened measures – without jeopardising the subsistence level enshrined in the Constitution.

The Federal Ministry of Labour and Social Affairs announced to take our findings into account in the future development of basic income support. We will keep a very critical eye on this development.
